Im In a Tax Conflict what to do
ok so l got my w-2 from my ex employer and well the wages that are on dont
match with my last check stub. According to my last stub, wages reported
on my w-2 are missing like $7,000 is it cuz l have been getting
unemployment? what my ex employer has that l made is ridiculous and well l
really didnt end in good terms with him so how do l approach this? Or is
this rite? or what happens if l file my taxes and l made more than what it
shows on my w-2?
Make sure you are comparing the right numbers (in other words
don't compare ur net earnings to Box 1 look to gross earnings). Box 1 of
ur W-2 will match gross wages on ur stub minus any qualified plans (like a
401k). You Box 1 wages may be lower than ur Box 3 wages because you made
qualified pre-tax contributions. Do you have an entry in Box 12 or 14 of
ur W-2. Did you get paid cash sometimes & not check? If he paid you cash
then he is not properly reporting it to avoid his portion of social security & medicare. If you still feel there is a mistake you must go back to ur employer to request a W-2C (corrected W-2).
You should get a W-2 from the employer and a W-2G for the
unemployment. I think you are thinking that everything will be in one,
rather than you get 2, one from your employer and one from the
unemployment authority.l
Any received unemployment has NO effect on ur W-2s. The state
wsill send you a 1099-G for unemployment received. It is not uncommon for
there to be differences between check stubs & W-2s, but that is a rather
large difference. Check carefully to make sure you are comparing all the
same things. Was there a cafeteria plan, a 401k, anything separate or
special?
Think you need to contact ur ex employer. The HR is generally where you go & they may be unaware of the terms of ur departure. They have an obligation to issue correct W-2s & they are sent to IRS, so you need to get to the bottom of this--or accept their numbers. You can not file based on paystub if you have a W-2, & even if you didn't, not before mid-February.
Unemployment would have nothing to do with your W-2. But if
you had pre-tax contributions for things like 401K, health insurance, or
FSA's, that could explain the difference, and your W-2 might be correct.
ask the company for a correct w-2 because to under-report
income in fraud - you can report them to the IRS if they don't fix it.
If they refuse go ahead & use the info on your last paystub & attach a
copy not the orginal to your 1040
The W-2 represents what the employer has paid to you for the
year 2007 & what they withheld from you. If you received checks or income
from another source, you will receive a 1099G which will tell you what ur
unemployment amounts were. This will go on another line of ur return.
Wait a few days to see if you receive this.
If you made more than what the w-2 says, the government will not have a record of it since ur employer will be reporting the same numbers to the government as they sent to you. Your situation seems to be you have received unemployment amounts which come from the State you live in. Once you get that information, you will be able to file ur return. I hope this was helpful. Call the IRS and have someone review the W-2 with you against
your paystub.
Did you remember to subtract pre-tax benefits like health care and tax
deferred income like 401(k)s?
My paycheck is usually $5-7K more than my W-2. 15% to my 401K and $1500 in health care will do it.
Your W-2 has nothing to do with collecting unemployment. You
will get a Form 1099-G from the State for that.
If the W-2 is wrong you will have to contact the employer and have them
generate a corrected one.
